Terms & Agreements for SLS Junk Removal
1. Services Provided
SLS Junk Removal agrees to collect and remove items ("Customer Materials") from the designated location ("Premises") as specified in the work order ("Work Order"). The services encompass residential, commercial, demolition, and cleanout waste management services.
2. Prohibited Materials
Customer Materials shall exclude any property that violates laws or regulations, including hazardous materials, waste disposal, and environmental regulations ("Prohibited Materials"). "Hazardous Materials" encompasses hazardous or toxic substances regulated by local, state, or federal laws.
3. Ownership and Disposal
Customer represents ownership of Customer Materials or has the right to transfer ownership to SLS Junk Removal. Ownership transfers upon Customer's signature on the Work Order. SLS Junk Removal reserves the right to dispose of Customer Materials as deemed appropriate.
4. Right to Enter
Customer confirms ownership of Premises and authorizes SLS Junk Removal to access the Premises. Customer assumes risks of damage from SLS Junk Removal's entrance, including non-paved areas.
5. Payment
Payment is due immediately upon job completion unless credit has been established. Unpaid balances may be subject to collections.
6. Disposal of Items
SLS Junk Removal reserves the right to dispose of items responsibly, prioritizing recycling and donation. However, certain circumstances might prevent this, including center refusal, contamination, infestation, weather, or other external factors.
7. Estimates
Estimates are provided based on provided information and allow for scheduling. Final estimates are determined on-site, reflecting the filled truck's percentage and additional fees.
8. Exemption from Liability
SLS Junk Removal and its agents hold no liability for Customer's non-compliance, including Prohibited Materials. No liability exists for property damage while removing Customer Materials, except for gross negligence.
9. Default and Remedies
In case of default, SLS Junk Removal can pursue legal remedies. Unpaid balances incur collection expenses, including attorney's fees.
10. Release of Customer Information
Customer authorizes SLS Junk Removal to release required information to comply with legal requests or authorities.
11. Indemnification
Customer agrees to indemnify, defend, and hold SLS Junk Removal harmless against claims arising from Customer Materials removal, except for gross negligence.
12. Force Majeure
SLS Junk Removal is excused from performance due to circumstances beyond its control, including acts of God, emergencies, war, labor disputes, weather, or other catastrophic events.
13. Entire Agreement
The Agreement constitutes the complete understanding between the parties and supersedes prior agreements. No representative can make agreements beyond those specified herein.
